Article 1. Subjects and scope of application<\/strong><\/p>\n

This provision applies to contractors and investors (hereinafter collectively referred to as \u201cContractors\u201d) who register for an account, access, and use the website of the Railway Project Management Board (hereinafter referred to as the \u201cBoard\u201d).<\/p>\n

The website is used to provide information, exchange documents, receive dossiers, and support investment preparation, the selection of contractors and investors, and project management activities in accordance with the law.<\/p>\n

Article 2. Account and login security<\/strong><\/p>\n

1. Account Registration<\/p>\n

a) The Contractor is responsible for providing complete, accurate, and truthful information as required by the system.<\/p>\n

b) The person registering the account must be the Contractor’s legal representative or a duly authorized person and shall be responsible for the accuracy and legality of the information and documents provided on the Website. The username and password are sent to the Contractor’s registered email address.<\/p>\n

2. Responsibilities of the Contractor<\/p>\n

a) Keep the username, password, and other authentication methods (if any) confidential.<\/p>\n

b) Be responsible for all activities arising from your account.<\/p>\n

c) Log out of the system upon completion of the working session and implement necessary measures to ensure the security of the access device.<\/p>\n

d) Immediately notify the Board upon detecting unauthorized access, the compromise of login credentials, or other information security risks.<\/p>\n

Article 3. Purpose of information collection and processing<\/strong><\/p>\n

1. The Board collects, stores, and processes the Contractor’s information for the following purposes:<\/p>\n

a) Managing user accounts;<\/p>\n

b) Facilitating the selection of contractors and investors;<\/p>\n

c) Evaluating dossiers and documents provided by the Contractor;<\/p>\n

d) Managing projects and fulfilling obligations in accordance with the law.<\/p>\n

2. The Board collects only the information necessary and appropriate for the purposes of data processing and in compliance with legal regulations.<\/p>\n

Article 4. Protection of the Contractor’s personal data and information<\/strong><\/p>\n

1. Data protection principles<\/p>\n

a) The Contractor commits to voluntarily uploading data to the website, ensuring that the data is up-to-date and accurate at the time of posting, and having taken the Contractor’s information security into consideration.<\/p>\n

b) The Board commits to collecting, storing, using, and protecting personal data in accordance with Decree No. 13\/2023\/ND-CP on personal data protection and relevant legal regulations.<\/p>\n

2. Information Sharing<\/p>\n

The Board does not provide, transfer, or disclose the Contractor’s information to third parties, except in the following cases:<\/p>\n

a) With the consent of the Contractor or the data subject, as prescribed;<\/p>\n

b) Upon the request of competent state authorities;<\/p>\n

c) Other cases as prescribed by law.<\/p>\n

3. Protective measures<\/p>\n

The Board implements appropriate technical and administrative measures to ensure information security and mitigate the risks of unauthorized access, loss, alteration, or disclosure of data.<\/p>\n

Article 5. Acceptance of Use and Limitation of Liability<\/strong><\/p>\n

1. Contractor\u2019s Acceptance<\/p>\n

By checking the \u201cAgree\u201d box, registering an account, or uploading profiles or documents on the Website, the Contractor is deemed to have read, understood, and accepted the contents of these Terms of Use.<\/p>\n

2. Limitation of Liability<\/p>\n

a) The Board strives to maintain the continuous and secure operation of the Website but does not guarantee that the Website will always operate without interruption or technical errors.<\/p>\n

b) The Board shall not be liable for damages arising from force majeure events or causes beyond the Board’s reasonable control, such as natural disasters, fires, widespread power outages, telecommunications infrastructure failures, cyberattacks, or other objective technical incidents.<\/p>\n

c) In the event of an incident affecting the Website’s data or operations, the Management Board shall take necessary measures within the scope of its responsibilities to rectify the issue, mitigate damage, and notify relevant parties in accordance with regulations.<\/p>\n

Article 6. Information retention period<\/strong><\/p>\n

The Contractor’s information shall be retained for the period necessary to fulfill the purposes specified in Article 3 and in accordance with the retention periods for records and documents related to bidding, construction investment, project management, and other relevant legal regulations.<\/p>\n

Article 7. Contractor\u2019s Rights Regarding Data<\/strong><\/p>\n

The Contractor and the data subject are entitled to exercise rights as prescribed by the law on personal data protection, including the right to be informed, the right to access, correct, or update data, the right to request a restriction on processing, and other rights as provided by law.<\/p>\n

These rights may be exercised via the following contact channels:<\/p>\n
